Senator Leila de Lima dared President Rodrigo Duterte on Wednesday to immediately arrest her amid continued allegations linking her to the Bilibid drug trade.

In a hastily called press conference at the Senate, De Lima decried insinuations that the violent riot inside the New Bilibid Prison (NBP) that left one high-profile inmate dead and three others injured, including convicted  criminal Jaybee Sebastian, could be her handiwork.

“Ano naman ang implication nila? Kagagawan ko naman yan? Sila ang nanggigipit sa akin. Masyado na nila akong ginigipit, inaapi tapos ganyan pa ang gagawin nila?”  she said.

“Lahat na lang sinisi sa akin. And they call themselves men! Ganyan ba ang mga lalaki? They are cowards, they are fools, and they are liars!”  she said.

(What are they implying? That I was behind this? They are persecuting me. I am the one being attacked here and yet they do that?

They blame everything on me. And they call themselves men…Are men like that? They are cowards, they are fools, and they are liars!)

De Lima then reiterated her call for the President to end this “madness.”

“Tama na po. In your desperation, Pangulo, para siraan nyo ako, hindi nyo na iniisip kung ano ang nagiging hitsura nyo sa mata ng bayan  at sa mundo. Kayo na po ang pinagtatawanan, hindi po ako. Inonsente po ako,”  she said 

“Tama na po. Sino naman  ang susunod nilang  gigipitin? Sino naman ang susunod nilang  gagawan ng kwento?”

(That’s enough. INyour desperation, Mr. President, to take a dig at me, you no longer consider your image in the eyes of the country and of the world. You are the one being laughed at, not me. I am innocent.

Enough. Who will you persecute next? Who will you make stories on?)

De Lima said  her former staff and officials had been telling her that they were being approached to speak against  her.

“And I feel so helpless. I cant help them with lawyers dahil kung papadalahan ko sila ng lawyers sasabihin nila ayan kasi popoprotektahan (because if I send them lawyers they will say it’s because they’re being protected)…What I’m supposed to do now? Tell  me,” she asked.

The senator  then dared the President to just arrest  her.

“Tama na, hulihin nyo na ako ngayon. Yun naman talaga ang gusto nyo. Ikulong na nyo ako ngayon. I’m here!  Do what you want to me,  Mr. President. I’ll wait for you,”  de Lima said.

(Enough, arrest me now. That’s what you want. Jail me now. I’m here! Do what you want to me, Mr. President. I’ll wait for you.)

The senator  said she would not leave the country despite alleged efforts by the Duterte government to link her with the illegal drug trade.

“I’m  not going to leave this country and escape anything because there’s nothing to escape from,” she  said.

In fact, she said, some of her friends had advised her to just seek asylum from other countries, following Duterte’s pronouncements that she would  end up in jail.

“Why should I do that?  I want to fight here in our country! Hindi po ako duwag  dahil wala po akong kasalanan. Yung mga nagtatago lamang at saka yung mga duwag ang umaatras. Hindi po si Leila de Lima, hindi po ako pinalaki ng tatay ko na maging duwag,”  De Lima added.

Senator Leila De Lima LOST IT in her latest press conference. She was visibly ANGRY, IRRITATED, FRUSTRATED and then went BALLISTIC. The former DOJ Secretary said “COME and GET ME”. This LEVELING UP in the sound of her voice, her angry tone and heightened emotional state can have SEVERE MEDICAL CONSEQUENCES like DEPRESSION, NERVOUS BREAKDOWN or SUICIDE. Since Senator De Lima has consistently said she would NOT RESIGN, then maybe she would be amenable to an INDEFINITE LEAVE OF ABSENCE. Several groups on Friday filed charges against former President Benigno Aquino III and former Budget Secretary Florencio Abad with the Office of the Ombudsman over the implementation of the Disbursement Acceleration Program, some parts of which were declared unconstitutional by the Supreme Court in 2014.

Aquino and Abad were charged with technical malversation, usurpation of legislative powers, and graft and corruption by complainants led by Bayan Muna Rep. Carlos Zarate, Bagong Alyansang Makabayan and Volunteers Against Crime and Corruption.

“The DAP was nothing but a presidential pork taken from forced savings then realigned for pet projects of the President. It was not a stimulus program as many of the projects approved by Aquino had nothing to do with stimulating the economy,” said Zarate.

 

This marked the second criminal complaint filed against Aquino since he stepped down from power and lost immunity from suit on June 30.

Last week, two relatives of the 44 police commandos killed in the 2015 Mamasapano incident filed multiple homicide charges, citing Aquino’s approval of the operation which the complainants described as “flawed.” Aquino dismissed the complaint as mere harassment.

‘Neither surprising nor unexpected’

In a statement issued Friday, former deputy spokesperson Abigail Valte said the charges filed by the progressive groups against Aquino were “neither surprising nor unexpected.”

Valte, also a lawyer, said the move was part of the “continuing harassment” on the former chief executive.

“This action from BAYAN is neither surprising nor unexpected. As soon as PNoy stepped down, they mobilized to rally at his Times Street home, unwilling to extend to him a peaceful homecoming,” Valte said.

“Unsatisfied, they mobilized again the next day, deliberately provoking the policemen assigned there in the hope of manufacturing violence to boost media coverage of their shenanigans,” she said.

Aquino went back to his residence at Times Street in Quezon City after he formally stepped down from office last week, June 30.

“It is clearly part of their continuing harassment of a president who refused to be cowed by their chest-beating during his entire term,” Valte said of the incident.

Aquino has yet to receive a copy of the complaint, according to Valte.

Meanwhile, Abad said on Friday that he has yet to get a copy of the complaint.

“I still have to see the complaint filed by the Makabayan. We will reply once we get a notice to do so by the Ombudsman,” he said in a text message.

SC ruling vs. parts of DAP

The SC ruled against the constitutionality of some aspects of the DAP in 2014 but modified it in February 2015 after the government filed an appeal.

In its modified ruling, the high court said DAP authors could be held liable “unless there are concrete findings of good faith in their favor by the proper tribunals determining their criminal, civil, administrative and other liabilities.”

The presumption of good faith in the implementation of DAP-related projects still stands, according to the SC.

It also declared unconstitutional the withdrawal of unobligated allotments and the declaration of such as savings, the cross-border transfer of savings, and the use of unprogrammed funds despite the absence of a certification by the National Treasurer that the revenue collections exceeded targets.

For the complainants, Abad created the DAP while Aquino signed all the DAP memoranda that pooled the savings from various implementing agencies.

“Being the authors and implementors of DAP, respondents Aquino and Abad cannot raise the presumption of regularity in the performance of official functions in light of the conclusive and clear clarificatory confirmation or affirmation by the Supreme Court  that the implementation of DAP contravened the Constitution and the various GAAs (General Appropriations Act),” the complaint read.

“This presumption has thus been clearly rebutted by (SC) and there can no longer be any doubt as to the unlawfulness and illegality of respondents’ acts.”

Some P144 billion was spent for projects under the DAP, an economic stimulus package which only became public after Senator Jinggoy Estrada revealed in 2013 that a portion of the funds was used to bribe senators to support the impeachment of the late Supreme Court Chief Justice Renato Corona in 2012.

The Aquino administration denied this claim, noting the DAP was instrumental in boosting economic growth from 3.7 percent in 2011 to 6.8 percent in 2012.

Critics also tried to unseat Aquino through impeachment but it never worked out since the former leader’s allies had a firm hold on Congress.

The Ombudsman’s Field Investigation Unit, however, found enough basis last year to probe Abad and Budget Undersecretary Mario Relampagos over technical malversation and administrative charges regarding the use of nearly P400 million in DAP funds from 2011 to 2012.

MANILA, Philippines – Cases have not been filed against Sen. Leila de Lima for her alleged involvement in illegal drugs but President Duterte is confident that his fiercest critic would land in jail.

Duterte said yesterday De Lima would be pinned down by testimonies of New Bilibid Prison (NBP) inmates who have accused her of receiving money from drug lords.

“Now that she (De Lima) is in trouble, she wants to drag me. She will really go to jail. I’m sure of that because of the testimonial evidence,” the President said during the induction of officers of the Malacañang Press Corps, the Malacañang Cameramen Association and the Presidential Photojournalists Association.

“She will be jailed when everybody says, five (witnesses) could say that they contributed money. So on a national scale… who brought in the narco politics? It is here already.”

Asked if his statement is a go-signal for the justice department to file charges against De Lima, Duterte replied: “Yes, of course.”

“(Cases will be filed) after the investigations are finished. I am sure of my evidence,” he added.

The President said “plenty” of non-bailable cases related to drugs may be filed against the senator, who has been critical of his brutal war on narcotics.

“She’s the one who should be worried. Those are serious charges. She should not adopt a nonchalant attitude about all of these things. I said she opened the portals of narco politics to take hold in the national level,” Duterte said.

De Lima has been accused of receiving millions in drug money to fund her senatorial campaign when she was justice secretary.

In previous speeches, Duterte said De Lima’s affair with her former driver Ronnie Dayan made her violate the law and grant special privileges to drug lords at the NBP.

Last week, some inmates revealed in a House hearing that the NBP became a “little Las Vegas” during De Lima’s stint as justice secretary.

She denied the accusations and claimed that Duterte and his allies are ganging up on her because she launched a probe on the spate of drug-related killings in the country.

De Lima has been a critic of Duterte even before he assumed the presidency. When she was chair of the Commission on Human Rights (CHR), De Lima launched investigations on Duterte’s link to the Davao death squad, a vigilante group blamed for the killing of criminals in the city.

Duterte served as mayor of Davao City for more than 22 years.

Last week, De Lima was ousted by the Senate as justice committee chair due to her supposed bias against Duterte.

The committee had launched an inquiry on the killings of suspected drug personalities.

‘Her sexuality put her down’

Duterte said De Lima has no one to blame for allegations against her but herself.

“She was the one who started it. You’re all spectators who go down national, live, where it was evolving in the days that passed,” the President said.

“Lumaki ang ulo niya (It went to her head). When she was chairman of the (Commission on) Human Rights, somebody might have told her that she can become a president or senator. You know, the ambition was good but her sexuality put her down.”

Duterte said De Lima would be “finished” once intimate videos of her surface.

“I’d ask her ‘Miss de Lima, I’ve kind of a blurred, vague memory of your persona… I’m establishing the character of you. Is this you pumping? So the next question will be drugs,” he said.

“You know, every time I view the video, I lose my appetite.”

Duterte said De Lima need not worry about having affairs once she is in prison.

“She will have about how many lovers there if she wants. I am really tough when it comes to insulting… I am doing nothing and yet she keeps on talking,” he said.

The recent 2016 Presidential elections were not very good for the mainstream mass media. Printed newspapers (Philippine Daily Inquirer and Philippine Star) and the radio-television giants ABS-CBN and GMA7 were all accused of MEDIA BIAS in FAVOR of the Administration candidate Mar Roxas as well as NEGATIVE COVERAGE of Mayor Rody Duterte. Traditionally the Philippine Presidency was won on the basis of the amount of money poured into the coffers of the MEDIA MOGULS who ensured electoral victory. Then came cash-strapped Duterte who had to rely on SOCIAL MEDIA mainly due to his dire financial straits. Fortunately for Duterte, fewer voters were/are reading printed newspapers nowadays. The ubiquitous broadsheets, radio and TV news programs kept dishing press releases about the “INEVITABLE VICTORY” of Mar Roxas at the same time that BLACK PROPAGANDA was spread against upstart Digong. Major bones of contention focused on POPULARITY SURVEYS and the coverage of CAMPAIGN SORTIES. Duterte supporters claimed that paid surveys CONSISTENTLY and PERSISTENTLY  gave their candidate LOW RATINGS allegedly because opposing candidates PAID for those surveys. The belief then was that SURVEYS prepared or CONDITIONED the minds of the population for an Administration victory which would have made cheating more palatable and acceptable once Mar Roxas was declared the winner. After the landslide election victory, die-hard Duterte people still believe that CHEATING was attempted by the Aquino Administration (through Comelec) except that it was not enough to prevent a Duterte win.

Phenomenally huge CROWD SHOTS of the Duterte campaign trail seldom found their way into traditional mass media front pages or TV prime time news. On the other hand the Internet was PLASTERED all over the place with photos of Duterte crowds in the HUNDREDS of  THOUSANDS. It was not difficult to conclude that Facebook, Twitter and Instagram soon became the MORE CREDIBLE SOURCES in knowing the number of the participants in the campaign rallies. A BANDWAGON EFFECT was generated and the rest, as the saying goes, is history.

Today, post-Presidential elections, the same four aforementioned media outfits are again the focus of complaints in terms of the treatment of Duterte stories. There have been on-and-off calls for a traditional mass media BOYCOTT. In fact, President Duterte, at one point, did not allow mass media coverage (except for the government stations) for his press conferences.

Assuming that the financial woes of the printed newspapers DID NOT START with the 2016 Presidential election, there have been declining paid circulation and ad revenues. Readership is DOWN and may NEVER RECOVER  because news can now be sourced online and through mobile devices. In other words, both Philippine Daily Inquirer and Philippine Star could CLOSE down without any help from the Pro-Duterte camp. However, the DUTERTE FACTOR could be the FINAL NAIL in the Inquirer and Star COFFIN.  Based on our financial analysis of both the PDI and Philippine Star corporate structures, distribution networks, ad revenues, subscription rates, costs of production and broadsheet selling prices (of individual copies), we have come to the conclusion that Inquirer is in a more PRECARIOUS and VULNERABLE SITUATION that may not be able to weather a BOYCOTT storm.
