President Duterte took the Department of Agrarian Reform to task by mentioning the slow process of land conversion and accusing erring officials that were never named. In a number of Presidential speeches, he threatened to fire the still unknown officials and also gave them the option to retire or leave government service. Weeks after the tirades, no further details were provided nor was the public informed of the resolution of the mentioned case or what happened to the DAR officials.

Then comes to light a six month old ABUSIVE BEHAVIOR by a DAR main office DIRECTOR, head of the DAR public relations arm with ANGER MANAGEMENT PROBLEMS, a VIOLENT OUTBURST and SUICIDAL TENDENCIES (he punched the wall of his office causing a HOLE in the WALL, no pun intended; self inflicted injuries are a cause of concern and should be referred to a psychiatrist, such actions could be a manifestation of depression, unstable mental state and/or suicidal tendencies; immediately after the incident, he should have been placed on a 24 hour suicide watch under competent medical supervision). The Department of Agrarian Reform is taking its sweet time in resolving the issue or coming out with a definitive judgement on the case.

There is also an allegation of PAYOFF in the settlement of a land conversion case.

SIX MONTHS after – still UNREPENTANT and UNPUNISHED

Marami ang bilib kay Pangulong Duterte sapagkat napapatino niya ang mga kawani ng pamahalaan. Lingid sa kaniyang kaalaman, isang Presidential Appointee na mismong si Pangulong Duterte ang nagtalaga sa Department of Agrarian Reform, ay nagpamalas ng hindi kanaisnais na pagkilos para sa isang government official. Ilang buwan na ang nakakalipas at hindi pa rin napaparusahan ang Director ng DAR Press and Media Relations Office na tila malakas ang kapit sa nasabing departamento ng pamahalaan.

Kung filing clerk o office secretary siguro ang nakagawa ng pagwawala, paninigaw, pagmumura, panununtok at pagsira ng pagaari ng gobyerno ay mabilis na siguro nabigyan ng katarungan at nalapatan ng kaukulang kaparusahan. Pero dahil Presidential Appointee nga ay TAKOT ang mismong departamento niyang pitikin man lang ang nakagawa ng kahihiyan. Tanging Pangulo lang daw ang makakatanggal sa kaniya sa pwesto NGUNIT hindi naman nagpapadala ng incident report at recommendation for disciplinary action ang DAR sa Malacanang. Sa madaling salita, delaying tactics ang paraan na ginagamit ng DAR at umaasa sila na sa tagal ng panahon ay magkakalimutan na lang.

Diba pinagyayabang ni Tatay Digong na sa Davao mabilis ang aksyon sa mga reklamo. Tatlong araw lang daw ang dapat para sa mga pangkaraniwang suliranin. Eh bakit sa DAR, anim na buwan na hindi pa kumikilos para mabigyan na ng kaparusahan ang nagkasala. Exempted ba ang DAR sa mga utos ng Presidente? Diba ang DAR ay nasa ilalim ng Executive Department na pinamumunuan ng Pangulo?

Mataas ang popularity rating ng ating Pangulo ngunit ang isang ALTER EGO niya ay nagkakalat ng lagim sa pamamaraan ng maling pagkilos na naghahasik ng takot sa mga nasa ilalim niya sa opisina ng DAR. Kung hahayang makalusot ang nagkasala, anong klaseng halimbawa ang pinapakita natin sa buong Departamento, na okay lang ang mambastos at hindi magpakita ng paggalang sa kapwa tao? Ginoong Pangula manawari ay makarating sa inyo itong pangyayaring ito na pilit itinatago at nililihim sa inyo. Gaya ng nga sabi sa DAR, kayo lang po ang may kapangyarihang iatras ang napirmahan ninyong appointment sa tiwaling Director na ito. Dapat FIRED on the SPOT, SUMMARY DISMISSAL from government service and PERPETUAL DISQUALIFICATION to hold public office.

Mr. President – Please look into the ABUSIVE BEHAVIOR, GRAVE COERCION and DESTRUCTION of GOVERNMENT PROPERTY of your Presidential Appointee at the Department of Agrarian Reform main office with the name of Cleon Lester Chavez, Director of the DAR Press and Media Relations Office. Last February 11, 2019, said political appointee lost his temper, shouted at the top of his voice, mouthed bad words, punched a number of times the person he was berating (the person moved back and avoided being hit). The Director then punched the wall leading to his office which produced a hole. The Office of the Secretary of DAR has not released any judgement in this case six months after the dastardly act. The Director has remained unrepentant and unpunished up to this time. Thank you.

NBI investigating DAR chief Castriciones for alleged P5M land payoff
Castriciones strongly denies the allegations, and says cases over the issue have been filed against the complainant herself

MANILA, Philippines – Agrarian Secretary John Castriciones is being investigated by the National Bureau of Investigation (NBI) over an alleged P5-million payoff in a land conversion issue under the Comprehensive Agrarian Reform Program (CARP).

“Perusal of submitted pieces of evidence shows that all complainants and witnesses attested that Sec. Castriciones received a total of of five million pesos in exchange of a Department of Agrarian Reform (DAR) order exempting a piece of lot from CARP,” said an NBI progress report dated May 16, 2019.

NBI Director Dante Gierran forwarded the report to the Presidential Anti-Corruption Commission (PACC) on May 17. PACC Commissioner Manny Luna told Rappler on Saturday, July 13, that Castriciones has volunteered to undergo a lifestyle check.

Castriciones confirmed to Rappler on Saturday the lifestyle check and the existence of a pending NBI investigation.

Castrictiones strongly denied the accusation and turned the tables on the complainant, Maricon Doctora-Sayas.

“The complainant Maricon Doctora is a fixer who has been under investigation by the DAR Legal Service (DAR LS) and Anti-Corruption Task Force (DARAC TF) even before February 2019 prior to the execution of her perjurious sworn statement,” Castriciones said.

“For the record, I did not receive any bribe money,” Castriciones told Rappler.

Castriciones said it was Doctora-Sayas, who transacted and received the P5 million and that cases have been filed against her before the Office of the Ombudsman. Castriciones said he even requested an investigation from the Office of the Executive Secretary.

Complaint

The issue involves a certain Glenn Espaldon, who, Castriciones said, filed the first complaint against Doctora-Sayas which prompted an internal investigation within DAR.

“The investigation against her was brought about by the complaint of a certain Glenn Espaldon, who executed a notarized affidavit stating under oath: (1) the details of the transaction between him and Doctora-Sayas; (2) how Doctora-Sayas represented to have the power to secure an approved conversion order; and (3) how she received cash from Espaldon in separate instances amounting to P5 million,” Castriciones said.

Espaldon also submitted sworn statements and documents to the NBI, according to the progress report.

Castriciones said Doctora-Sayas did not respond to the summons sent to her by the DAR investigating team, and proceeded instead to file a complaint against him before the NBI.

“To begin with, there is no pending conversion application with DAR regarding the landholding being referred to by Doctora-Sayas,” Castriciones said, adding that Doctora-Sayas has offered herself to be a state witness.

If proven true, the bribery will fall under Article 210 of the Revised Penal Code and the anti-graft law, according to the NBI.

“I am willing to cooperate with any investigation, and have been doing so for the past few months because I do not fear the truth and I have nothing to hide,” said Castriciones.

Land conversion anomalies

The DAR has come under fire in Malacañang after President Rodrigo Duterte lashed out at the slow land conversion process. But Malacañang said Castriciones was still trusted by the president.

In response, Castriciones created a task force that investigated alleged anomalies in land conversion transactions.

“Clearly there are forces working to discredit me before the President and the Filipino people, knowing full well the President’s stand against corruption in government service and how the mere whiff of corruption would be sufficient for the President to remove appointed government officials,” Castriciones said.

Castriciones was appointed to DAR after a controversial stint as undersecretary of the Department of the Interior and Local Government (DILG), where he was accused of corruption by employees.

Castriciones was active in Duterte’s presidential campaign, serving as executive vice president of the Mayor Rodrigo Roa Duterte (MRRD) group, a nationwide volunteer organization. – Rappler.com
